We’ll have much more tomorrow on the Secret Service and the likely compromise therein, but in the meantime, the golf course gunman or GCG --- we choose not to glorify the names of shooters in our reports --- was indicted on Tuesday for the attempted assassination of former President Donald Trump.

Detention is a surprisingly unfamiliar experience for the GCG, because even though he’d been arrested 74 times before this and faced over 100 criminal charges, he’d spent no time whatsoever as a distinguished guest at the Graybar Hotel.  EVER, as far as we can tell.

Investigative reporter Steve Baker, who covered January 6 as an independent journalist before being hired by BLAZE MEDIA, is asking all the right questions as to why this might be.  So far, we don’t have the answer to this mystery, but stay tuned.

Even this time, he might not spend as much time behind bars as he deserves to.  Believe it or not, Alan Dershowitz said Monday that he doubted federal prosecutors could make the case for attempted assassination, even though the gunman appears guilty of that charge as you or I understand it.  The man was sitting right there in the bushes, with his weapon allegedly trained on the place Trump was about to be, when he was disrupted by a Secret Service agent.

In what Dershowitz called a “free Harvard criminal law class,” he explained that if they can’t prove he CONSPIRED with someone else to do it, they have to show that he ATTEMPTED it.  The problem: “Criminal law distinguishes between preparation and attempt,” he said.  They could say that everything he did up to the point he left the scene was part of the preparation, or planning.  “He never had the President in the line of fire, and of course he never pulled the trigger.”

We know with little doubt that this man was trying to kill President Trump.  But the law is infuriatingly unclear about what turns “preparation” into “attempt,” short of pulling the trigger.  This reminds me of Bill Clinton’s famous lawyerly answer about what the meaning of “is” is.
