1.  THE NUREMBERG CODE, "INFORMED CONSENT," AND VACCINE MANDATES

Can Americans really be forced to get "fully vaccinated" for COVID? It depends on whom you ask. One newsletter reader asked us.

If "settled law" is so valued by the [Left], then perhaps they should go back a bit and read the 1947 Nuremberg Code. This right to refuse forced injections, such as the COVID-19 vaccine, implements the internationally agreed legal requirement of Informed Consent established in the Nuremberg Code of 1947. As the Nuremberg Code established, every person must "be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, overreaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision" for any medical experimental drug, as the Covid-19 vaccine currently is.

Seems the Biden Admin has forgotten what facilitated the extermination of millions of Jews?

Dear Allen:

Thanks for making this point about coercion when it comes to medical treatment. The Nuremberg Code was established after World War II and the horrific discovery that the Nazis, under the direction of “mad scientist” Dr. Josef Mengele, used medicines and procedures, including experimental ones, to Jews against their will in the name of “scientific research.” It was determined that this should never happen again.

Do a search on “Nuremberg Code COVID-19 vaccine,” and several “fact”-check websites come up, so we assume this question has been asked numerous times. POLITIFACT predictably rated this claim “false.” No, they say, the Nuremberg Code does not apply because the COVID-19 vaccines are not experimental, as they received emergency-use FDA approval.

POLITIFACT says, “One of the Nuremberg principles is that humans should not be subject to medical experiments without their voluntary consent. The COVID vaccines have been tested in clinical trials with people who gave their consent.” (Ah, THOSE people gave THEIR consent.) POLITIFACT says an “expert” told them that the premise that COVID-19 vaccinations are medical experiments is “not true.”

They attempt to cover their bases by pointing out that the Nuremberg Code is not part of U.S. law.

Mary Ellen O’Connell, a law professor (not a doctor) at the University of Notre Dame School of Law, said, “No one taking the vaccine is being subjected to experimentation. If you refuse for reasons other than medical issues or religious teaching, you may lawfully be barred from certain activities where you may infect other people. That is your choice, not coerced by the government.”

POLITIFACT reports that “while vaccine skeptics often use the term ‘experimental agent’ when referring to the vaccines, the FDA refers to them as ‘investigational vaccines.’” Ah, that’s very different!

“During public health emergencies,” POLITIFACT says, “like the coronavirus pandemic, the FDA has the legal power to grant emergency use authorization to certain products if they meet specific standards and if there’s no adequate, approved and available alternative to treat the malady.”

Right off the bat, we see problems with their verdict of “false” and enormous room for debate on the question. We’re not lawyers, but we’re confident of winning the ethical debate.

First, is a treatment not in any way “experimental” just because the FDA approved it? If all it takes is FDA approval to miraculously take that label away, then there needs to be a lot more trust in our health care bureaucracy than currently exists.

Particularly when it comes to giving these vaccines to children, they are still experimental. During the recent eight-hour meeting that led into an FDA advisory committee vote to approve the vaccines for youngsters 5-11, Dr. Eric Rubin said, “We’re never going to learn about how safe the vaccine is unless we start giving it, and that’s just the way it goes. That’s how we found out about rare complications of other vaccines.”

That sounds pretty experimental to us.

Dr. Cody Meissner, a pediatrician with Tufts Medical Center, voiced a concern that “if we say yes, then the states are going to mandate this vaccine for children to go to school, and I do not agree with that.”

A temporary committee member, Dr. James Hildreth, expressed concerns about the estimated 40 percent of children who already have some form of immunity to COVID-19. It sounds as though, among these doctors, there are significant unanswered questions. So we do not agree that the COVID vaccines are not experimental, regardless of the FDA vote.

POLITIFACT says that during a public health emergency, the FDA has the power to grant emergency use authorization. That was to make the vaccine AVAILABLE, not to force people to take it.

As for the idea that people aren’t being forced, that it’s their choice after being barred from certain places and activities, we take strong exception to this interpretation by POLITIFACT’S chosen “expert.” If a person is denied the ability to make a living, or to leave his home, or a child is denied the right to go to school, that is duress, which is clearly a violation of the Code. (Also, some employers are not granting medical or religious exemptions.) To reiterate what Allen said in his letter, the first principle of the Nuremberg Code states that the voluntary consent of the human subject is absolutely essential...[the person must] be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion.”

This principle also stresses the need for INFORMED consent. At present, with so much censorship and control of the narrative by the medical/pharmaceutical community and the government, it could be argued that many Americans don’t know the risks they’re consenting to, and they're even made to sign a waiver before they get "jabbed." They only know their boss told them they need to do it if they want to keep coming to work.

According to employment attorney Daniel A. Gwinn, “The Equal Employment Opportunity Commission has decreed [EDITORIAL NOTE: “decreed”??] that an employer may require its workers to be vaccinated as a condition of employment, unless they are medically unable to safely receive the vaccine or have bona fide religious objections.” But he also supports what we said earlier: “If you have been given a choice between getting the shot or losing your job, your decision is not voluntary, and being forced (on pain of losing your job) to sign a form that states the decision to be vaccinated is [made] voluntarily won’t make it so.”

Clearly the mandate is unethical. But one thing is true: the Nuremberg Code is not codified into U.S. or state law. (We would add that even so, it’s been cited multiple times in case law, even before the Supreme Court; see link below, especially cases 9 and 10, which involve the COVID mandate.) Does that mean it’s just another vestige of our history, to be discarded by our society when leaders find it inconvenient? Perhaps the states that care about individual rights should look into making it law, and without delay. No one should be forced to experiment with his or her health.

4. VEEP'S NEW BORDER EFFORT:

Vice President Kamala Harris, who was put in charge of our border crisis months ago, is finally taking some action on dealing with border security. She’s flying to Paris for a conference on how to keep Libyan refugees from flooding into Europe.

Okay, technically, it’s not OUR border she's trying to secure. But at least she’s finally in the ballpark.

5. IMAGINE IF TRUMP DID THIS:

When Donald Trump was in office, we kept hearing about how he was lawless and was destroying the Constitution. Yet every time a federal judge overstepped his authority to rule that a Trump order was unconstitutional, Trump would respect the system, obey the ruling and keep appealing until the Supreme Court usually found in his favor. By contrast, it’s been Joe Biden who has routinely ignored court rulings against him. And now, here’s the latest example.

The Fifth Circuit Court of Appeals ordered a block on his OSHA vaccine mandate on private businesses, ruling that it raises “grave statutory and constitutional issues.” Biden’s response: he’s telling businesses to ignore the court ruling and go ahead and do it anyway.

My ears hurt just imagining the screaming from the media if Trump had ever pulled such a dictatorial move.


6. LEFT BEHIND:

NBC News obtained a memo issued by Undersecretary of Defense for Policy Colin Kahl, instructing “any U.S. military personnel and DOD civilians with immediate family members who need help leaving Afghanistan to email his office.”

NBC reports that there are still “several dozen immediate family members of U.S. service members in Afghanistan,” including children, parents, sisters and brothers, plus well over 100 extended family members. But defense officials claim it’s not clear how many of them want to leave. Anyone want to hazard a guess?

Reminder: the catastrophic pullout from Afghanistan happened in August. All our people should have been removed before the troops pulled out and the Taliban took over, but they were left behind. We were repeatedly told there were only about 100-200 left, but that number has only gone up for some mysterious reason. And now, we learn that both extended and immediate family members of our military service people are still stuck there. And it’s now November.

How about if the President and all his staff stop jetting off to climate conferences and get those people safely out of there before Thanksgiving, so they finally have something to be thankful for?

7. UNEXPECTEDLY BURNED: 

Here’s something you almost never see: a guest host from ABC’s “The View” bringing up Rep. Adam Schiff’s slanderous lies about “Russiagate” and his fervent promotion of the now-debunked “Russian Dossier” to his face, and not letting him slime away from answering for promoting “Russian disinformation” himself. It was as satisfying as the final scene in a Dracula movie where the Count is finally forced to look at a cross, and he melts down.

Schiff’s response: “Well, I completely disagree with your premise.” You know, every time I step on the scales, I disagree with gravity. Yet, that doesn’t make me weightless, any more than Adam Schiff disagreeing with the truth makes him honest.


8.  DURHAM RECAP

We’ve been talking about the Durham investigation, the indictments and their significance for a long time. It’s nice to see that’s finally breaking through in the news, even if it is mostly conservative sources so far. This is a good recap if you haven’t been keeping up.

It will be interesting to see if there are more indictments and if they get higher and higher profile, how long the liberal news outlets will be able to keep sticking their fingers in their ears and saying, “La-la-la, I can’t hear you!”

9. A BAD EXAMPLE: JOE BIDEN

I haven’t mentioned this story on purpose because it’s gross and juvenile, and there’s no way really even to verify it. But people being the way they are, it’s getting a lot of comments. I'm sure the Biden-protecting "fact checking" sites will soon be trying to sniff out a way to dismiss it. So I guess I at least have to let you know what they’re talking about. It’s a story about how President Biden allegedly set a bad example for restricting emissions at the climate change conference.

Again, I won’t go into more detail than that. Except, to put a positive spin on it: if true, it’s the first time since he took office that he did anything to produce gas from an American source.

 

10. A GOOD EXAMPLE: MATTHEW MCCONAUGHEY'S COVID VACCINE COMMENTS: 

I’m expecting to see more of this sort of thing as people get tired of being told to shut up and do what they’re told by the government: actor Matthew McConaughey says he’s going to need to hear more information before he lets his young children be given the COVID vaccine.

McConaughey made it clear that he and his wife are vaccinated. Because his 90-year-old mother lives with them, he did it because he “chose” to, not because he was told to. And he’s taken the pandemic very seriously and doesn’t believe in conspiracy theories. He said it’s time to “get off that narrative” of accusing anyone who expresses concerns about the vaccines of being a conspiracy theorist. His kids are 8, 11 and 13 (I’d note, ages at which COVID has had virtually zero effect), and he said rather than letting the government mandate that he give a new vaccine to them, "I still want to find out more information…There will come a time where you're going to have to roll the dice one way or the other and go: ‘Where are the numbers in my favor?’"

I generally don’t get into celebrity comments about political or public health issues, because they’re usually just so irrational and uninformed. But I thought you might be interested in this comment, because it’s so unusually rational, it’s brave for him to say it in an industry that runs on leftwing hysteria, and there’s talk of him possibly running for Texas Governor, so I thought you might want some insight into how he thinks.

    I listened to an interview yesterday with Ben Carson. He explained his thoughts and medical knowledge very well. He discussed his major concerns about giving the Covid shots to children. He does NOT recommend it.
