It’s great to see so many readers engaging with us, commenting --- both pro and con --- on our voice of reason at this time of mass hysteria. We’re trying to get through all the letters, promise! Here are responses to two more...

I just have three quick questions:

1.) Since Senator Patrick Leahy is presiding over the 'impeachment' trial, does he have a vote on conviction? The Chief Justice does not have a vote, so why should Leahy, since he is assuming that capacity.

2.) What gives Senator Leahy the authority to preside anyway? I cannot anywhere in the Constitution that says this it is permissible for a Senator to preside over an impeachment trial.

3.) The impeachment articles were delivered AFTER Trump had left office, and was a private citizen, What gives the Senate the authority to try ANY private citizen?

The short answer: none of this is constitutional. They are making it up as they go along.

Having Sen. Leahy presiding over an impeachment trial is entering uncharted territory, since the Constitution says “the Chief Justice SHALL preside...” Chief Justice John Roberts has wisely chosen not to accept this dubious honor and will play no part in the "trial," so Sen. Leahy has graciously taken it upon himself. I assume he will decide for himself whether or not his vote counts. My guess is that it WILL. This whole circus is already so unconstitutional that, hey, why the heck not?

So, with President Trump already out of office and the Chief Justice not presiding, is what we have even a real impeachment trial? I’m not a legal scholar by any means, but I certainly have a lot of company in saying it is not. What we have here is a big fat banana-republic-style show trial. Your friend is correct in saying the Senate does not have authority to try a private citizen.

Accordingly, Trump’s attorneys are arguing that this entire process is unconstitutional, not only for the reasons mentioned above but also because the House impeachment was conducted without any due process. They also say that Trump is innocent of the charges he was impeached for, having never incited violence, and that they can present evidence that the Capitol breach was planned well in advance of his speech.

Democrats want to "convict" Trump because they think it will prevent him from holding office again, ever. They said he didn’t deserve to in their legal brief filed February 2. (The "trial" is scheduled for next week, starting February 8.) But legal experts point out that they don’t have this power other than with appointed offices, not elected ones. And to do this, even if it were constitutional, they’d have to reach a 2/3 vote on conviction, which they are not going to get.

Will this common-sense argument stop the Democrats? Of course not. But Sen. Lindsay Graham has said that if they call even one witness, Republicans will call a slew of their own, tying up the Senate for weeks at least. Maybe they'll even call the guy in the Viking helmet, if only to establish that he was there at the Capitol long before Trump gave his speech and didn’t even hear it.

Personally, I’d like to see the Republicans call John Sullivan, the left-wing activist who participated, was arrested and charged but then violated terms of bail. What was he really doing there?

I’d like to know how many other left-wing activists were involved in the Capitol breach. Again, we know the so-called insurrection was planned quite a while in advance and had nothing to do with what Trump said.

On the other hand, Trump’s attorneys say they won’t be bringing in the issue of election fraud. It apparently is not true that Trump parted ways with his previous team over that issue. New attorney Bruce Castor said, “There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it. President Trump has plenty to win with what he has.” Here’s more from THE EPOCH TIMES.

Jonathan Turley warned that even the House impeachment –- not even counting the Senate trial –- was doing great damage to the Constitution.

Turley said, “With seeking his removal for incitement, Democrats would gut not only the impeachment standard but also free speech, all in a mad rush to remove Trump just days before his term ends.” He said that Trump’s speech did not meet the legal standard for “incitement” and would be seen by the Supreme Court as protected speech. This sounds like just the kind of defense Trump’s attorneys are planning for his trial.

"The damage caused by the rioters...was enormous,” Turley said. “However, it will pale in comparison to the damage from a new precedent of a snap impeachment for speech protected under the First Amendment.” Of course, the House did it anyway.

Thanks for allowing me to comment, Governor. I am very disillusioned, with the Republican "club," and you. For two or three years, you have been chicken little on these CIA/FBI pending indictments. Time and again you breathlessly announced that charges, indictments and jail time was coming. The Democrats are destroying America with unbridled activism and relentless action while the "club" stonewalls and stands around in togas, all the while complicitly skewering Trump. Disgusting. 74 million Americans will not soon forget this insider treachery. Loyalty is supposed to work both ways. I wish Trump would start a 3rd party.

Thanks for writing, Paul, but I think you mischaracterize my reports. The investigations have been interminable, and I don’t think we’ve ever said anyone was going to jail. We’ve said people DESERVE to go to jail, which is a different thing entirely. I share your abject disappointment and disgust that no one has been held accountable.

We can tell you what investigators have turned up, and we can point you to solid sources and great books exposing much of the deep state, but as for accountability, well, we can’t do anything about that, much as we would like to.

So, you put me, personally, in “the club,” wearing a toga, standing complicit as the Democrats skewer Trump? Aside from thinking I might look pretty silly in a toga, I have to wonder where on earth you get that image of me. I ran for President; didn’t QUITE make it. I have no power to put anyone in jail, as appropriate as that might be. I've made it crystal clear what I think about the double standard of “justice” in Washington DC.

Right now, increased activism is the very thing I’m encouraging for embittered Republicans. As for starting a third party, that would be the worst mistake conservatives could possibly make. Democrats are hoping beyond hope that we do. Start a new third party, and conservatives will never, ever, ever win another Presidential election. Ever. Guaranteed.

    I clicked on the story about the Black Hawk helicopter crash in Idaho and saw the following -
    On January 20th, a Black Hawk from the New York National Guard -- which was also on a training mission -- crashed outside Rochester, killing three veteran pilots.

    Coincidence? Related? Your thoughts please.....thank you

    I have also thought about a third party that would draw from both parties. I have a hard time believing that all Democrats are leftists. Surely there is a group of Democrats that have moderate to conservative leanings, and that they do not Republican because of the name.

    In my humble opinion, this whole impeachment is a sham and show by democratic politicians with the main theme of the show being the trashing and disregard for our Constitution. Sometimes you can't see the forest thru the trees and the democrats are using the Constitution as a door mat, wiping their "elite" feet on it by showing the American people "they" can what ever they dam well please", laws or no laws. Should Trump win, loose or draw, the main focus by the American people should be the total disregard of the body of laws found in our Constitution that have kept our democracy well and healthy for over 200 years which they are now violating by this pending impeachment of former President Trump. Today our Constitutional laws have been thrown aside by an elitist group of power hungry bureaucrats who may decide to rewrite our Constitution down the road with one more conforming to those of a dictatorship and socialist country which history has proven they do not work. The "red flags" are hanging from the trees in the forest but very few can see them thanks in part to out media.
    God help us
    Just an observation from an "old guy" passing thru to someplace much better.

    Thank you, Gov. Huckabee, for staying in the army of patriots on the front lines who are gifted with good sense and communication skills. I pray for you daily, and I hope this note will give you a dose of encouragement.

    I am currently in a rehab facility, recovering from COVID pneumonia, thankful to be alive. One benefit for me is that I have time to read your newsletters more thoroughly. BTW, I’m glad you put the daily scripture verse at the top.

    I was particularly moved by yesterday’s and today’s undertones encouraging conservatives not to give up or give in. It’s hard not to be discouraged, especially when you know that there is so much corruption and wanton disregard for law and order in this country now. I have long admired you, Gov. Huckabee. Your ability to lay out the facts and explain them in an easy-to-understand way has been like a lightning rod of encouragement for me.

    I will be looking for ways I can support the front line patriots, even a little.

    I will never again order any of the books you advertise. I ordered the children's book on Socialism and was immediately told that I would be sent other books every month with two different charges on my credit card. I got it stopped by calling and emailing these people. why do I have to take my time to stop something I did not order?

    Hi sir thanks for this comment section. You mentioned that if a new Republican Party is formed will never win another election. It’s pretty telling when Republicans won the last election and look what happened. Dembocrats lied and cheated and threatened and stole the election with no consequences from what I’m seeing. So it’s very clear the real stooges are the republicans in DC who let this country down big time.

    Agreed!! The conservative America First infusion into the Republican Party has already encouraged some Rinos, and never-Trumpers to resign their affiliation and leave the GOP. This foothold has been achieved in the last election and needs to be expanded. By increasing the awakening about foundational American ideals and resurrecting the accurate depiction of our history, warts and all, we can re-establish the American Identity. Preservation of accurate history is a necessity, in addition to increased conservative involvement at the local level; elections, schools, city, county, and state. Be Blessed, the silent majority can't stay silent.

    Just a comment to say if this was akin to a real trial, the Senate , having even heard about the storming of the Capitol , let alone being victims, would be rejected as jurors. Wouldn't they ??? I find it troubling that news agencies such as CBS will just out and out just 'pronounce' that President Trump DID incite the riot.

    Hi Governor Huckabee,

    I have been getting your newsletters and reading them for at least 5 years (although for some reason I stopped getting them after the election, so I re-subscribed and shortly thereafter I started receiving them again). I agree with you 99.9% of the time. I have been a Republican since George H.W. Bush (maybe the second term of Reagan, but I was upset at Reagan when he took away my much needed Social Security benefit for college since my father had passed away, by which it is why I voted Democrat also); I was democrat before then, but I was young, dumb and stupid. Then again the Democrat Party was much different then and I was for the people. The saying was that Democrats were for the people and Republicans were for Big Business. I have been a Christian since I can remember and now shamefully looking back when I was young and believed in the Democratic platform (then again the 60’s and 70’s were very liberal times with “Free Love” and all). Then I grew up and started realizing several things about the Democrat Party that I was not in agreement with anymore (abortion for one). But now I am older. People say that as one gets older, one becomes wiser. I don't know if I am wise or not, however I am not so sure about not having a Third Party...you know that 0.1% of disagreement with you.

    The Republican Establishment is just as bad as the Democrats. The thought that 5 Senators...one of them being one of my Senators (Pat Toomey), would even go along and listen to this charade, blows my mind. The fact that Mitch McConnell would denounce Trump after 4 years of fulfilling promises he made during the campaign (except for when the Establishment Republicans would block him when we had the House and the Senate), and Trump would pretty much be on the mark with any statement he would claim, is just playing into the Democrats hand! I believe that if a Third Party would be available there would be enough people...like at least 74 million that would move to that party if that party represented the Constitution.

    When I heard that the Patriot Party filed to be a party, myself and a lot of my Trump supporting friends are ready to move to that Party. We are tired of the GOP continuously shooting itself in the foot. The one thing I have to give to the Democrat Party even though it pains me to say it is that they are at least a solidarity party even if their members don't believe in the Democratic issues at hand. If Pelosi or Schumer say to vote a certain way whether the person agrees or not, they vote the way the leadership of the Party wants them to vote. Therefore, the Republicans are screwed for their decency and beliefs. Whereas the Republican Party may do things relatively the right way by voting their conscience, it doesn't help the party when certain main issues arise...and we lose again.

    We had a strong President; one who withstood many and often attacks of lies and smears and still got the country to the best it’s been in my lifetime, and I'm pushing 60; not to mention he honored God in some ways by honoring Israel and fulfilling some prophesy by moving our embassy to Jerusalem and recognizing Jerusalem as their Capital and their sovereignty over the Golan Heights. I’m not saying Trump is a saint, but at least he acknowledges God and respects Israel. You won’t get that with Biden and the Democratic Party that is Anti-Christian and Anti-Jewish!

    It just floors me how the Establishment Republicans do not want to hear out the lawyers and people who say they have the evidence or witnessed the Election Fraud of 2020. What is the difference if we stay with a Party that will take longer than 2 years to clean house if the people stay with the Republican Party and be too late to survive the present administration or go to a new Party. Already people are not wanting to vote because of the Dominion Machines and Smartmatic Software, let alone voting for possible Establishment Republicans. We will lose both ways because people are tired of the Republican leadership’s BS.

    I have voted in every Presidential Election since I could and most of the elections in between since I had the ability to (I may have missed one election in my youth). I learned this from a man a long time ago when I was in college who came from Holland and said to me how lucky I was to have the right to vote for our leadership in our country as he was not able to. This was one of the reasons why he immigrated to the United States and became a citizen. To quote Hillary Clinton: “what difference does it make”...if Republicans don't vote because of the leadership of the Party and the crap they always pull by talking out both ends and doing nothing or voting in a different Party. The outcome may be the same but at least I will vote my conscience and be satisfied with my vote. How many times have you heard, “I guess I will have to vote the lesser of two evils”? I have said that many times and heard plenty of people say it. This time it turned out that Trump was the right choice this time. But what about next time?

    No one has been indicted, tried and thrown in jail and let's be honest, they never will be. The DOJ and FBI had 4 years to indict Hillary and her crew and they never did. Obviously, you don't want to throw your benefactor in jail; in other words, you don't bite the hand that feeds you! The only one who was tried because he plead guilty was given a slap on the wrists...by one of the judges that was scammed by the FBI and the DOJ??? Trump tried to empty the Swamp and it turns out he picked some Swamp people to try to empty the Swamp! I guess you can't judge some people by their cover! As much as AG Barr was so highly rated, he was Establishment also and did nothing. How is it that true journalists like your staff and other Conservative news outlets can find evidence of Election Fraud and other maleficence, report them and the AG or Supreme Court won’t see the evidence. The courts wouldn’t even HEAR (emphasis mine! LOL) the evidence. If the courts don’t hear them, who will? Congress won't look at the evidence. The State Legislatures looked at and heard testimony and still didn't do anything! The Judiciary check is gone. The Democrats won by cheating and now they will shred the Constitution as they said they would by packing the Supreme Court, and so many other things that will give them perpetual power, e.g. HR1. So a Third Party or even a Fourth Party isn’t going to make a difference in the outcome by the next election. If the Republicans were to have the votes for a majority in the House and Senate by 2022, HR1 will allow the Democrats to have China and any other foreign country flip the votes and we won't be able to anything other than go to war because the judiciary and the law will fail us by being corrupt...they won't even look at the massive Election Fraud from 2020! What would make anyone think they would look at it in 2022?

    However, having a Third Party at this time could do one of several things:

    1) There would be so much support going into that party, i.e. The Patriot Party, that the GOP would become extinct and the people that would run by this Party would have to be Constitutionalists and for the people and not themselves.

    2) Would give the now Republicans that were shafted by the Establishment Republican an outlet to be able to vote for a Constitutionalist, or conservative instead of a Rhino.

    3) There would be a possible inflow of moderate Democrats into the Party that believe in the Constitution and Bill of Rights…a real unifying effort.

    4) It may inspire the Democrats to form another party that would give the moderates a place to identify with and go back to the Democrats grassroots (not saying that they would be right) but it would give 4 Parties to contend with. 4 Parties might be able to even things out to where if the Democratic Party wants socialism and progressivism the moderate democrats could say, "No" I'm going to the moderate party and split the Democratic Party, too!

    Maybe they would combine in the future again, but I cannot go on supporting this Republican Party the way it is and what they did to clearly one of the best Presidents we have had in a long time. With all due respect, by the time we would have the time to vote out the bad and in with the Constitutionalist, the GOP will be over anyway!

    Sorry for the lengthiness. I realize that you may not be able to respond to me with any hope in the Republican Party, but feel free to try to convince me otherwise! Thank you so very much for hearing me and allowing me to air my frustrations. I know all hope is within Jesus Christ our Lord and God! As I see the gas prices rise, I get PTSD of the Obama regime! Lord come quickly!

    While I agree that starting a third party would weaken the Republican Party, I also think we need to disassociate the party from some of the extreme right factions, who are doing nothing but harm to the party!

    I think when the going got tough during the 2020 election the republican's all took care of their own agenda, a corrupt agenda. From the Chief Justice of the United States Supreme court, the governors and Secretaries of State of Georgia, Arizona and Pennsylvania just to name a few. I felt no reason to support corrupt politicians and left the party and do not understand why people think that the G.O.P. is the ticket to the future. Ross Perot took the election away from the republicans in 1992, I think a third party can do a lot with Independents, Democrats and conservatives, the corrupt republicans destroyed our voting system just as much as the Democrats, why would anyone feel elegance to them?

    You say that you’re against a third party, and that we’d never again win an election if that happens. I totally disagree! If we abandon the Republican Party in major numbers with the right candidate, I think we’d stand a better chance rather than having the same old shit on the menu! What chance will the republicans have when most of us are totally fed up with the crap that we’ve listened to for years and nothing changing (excluding President Trump) ! The rest of them are just filling a seat and going along with the democrat bs! They talk a good line when in front of the cameras, but go along with the dems behind closed doors and to hell with their constituents! What good will the Republican Party be when 2/3 of us will not vote for another Republican candidate ? I’ll vote democrat just to remove these spineless cowards that are in office trying to say that they have our backs!!! I’m done !!!!

    Governor, I think Paul's remarks represent the pure frustration that 74 million plus Americans are feeling (and I do think you would look rather silly in a Toga). The frustration comes from many high profile conservatives including yourself setting at least the expectation that "justice" would be served in the case of many who feel they are elites and above the law. No you did not say that people would go to jail, but given you are a respected public figure your desire to see those prosecuted gave hope that maybe for once it would really happen. Are we now a banana republic? Sure feels like it. There are many that feel short of an actual uprising (which the left would love to see) there is no hope. There is also no hope in sitting on our hands doing nothing, hoping somehow the Phoenix will once again rise from the ashes.
    I would like to see that many in position of influence like yourself would rise up and organize real efforts that affect real change. I am doubtful that the 2022 elections will force a majority change in the House or the Senate given the same voting policies and machines will be used that produced the 2020 results! In other words, I think if everyone in America voted conservative somehow in the middle of the night 168 million ballets would be found and change the results. It is hard to keep faith (other than in God) in a system that has proven itself to be so corrupt. I also urge Paul and those who think starting a 3rd party is a good thing. That of course is a result of feeling helpless to do anything or having faith that the republican party will somehow change.
    That would be the worst thing that conservatives could do is split the conservative vote. We need to work like the Tea Party did and incorporate the changes necessary within the Republican for for gosh sakes, vote the Rhinos out!!!! Thanks for letting me rant.

    When Lincoln was elected in 1860, the Republican Party was only six years old. That election was the end of the Whigs.

    Nonetheless, although I think organizinga third party wouldbe a hoot, I agree that a Trump Party would not have enough support to get out of the gate successfully.

    The 74 million people who voted for Trump are not going to run. down and change their registration. Many were Independents and many were "hold-your-nose" voters who chose Trump over Biden because Captain Marvel wasn't on the ballot.

    750,000 Georgians who voted in November didn't bother to show up for the critical Senate runoff elections a month later. Probably around half had voted for Trump.

    Talk is easy; winning elections isn't.

    I agree that a third party would be a disaster. However, we, Trump supporters, need a place to go. The Republican Party looks less and less like that place. We’re fed up with namby pamby Republicans and worse, RINOs. We need a place where our Trump support and his policies can go.
    I see a hybrid party/PAC that would not necessarily run candidates but support primary and general election candidates who share our enthusiasm. It would have to be an organization if not led by Trump but at least endorsed and supported y him.
