If you have a strong stomach and want to watch the Senate impeachment "trial" that starts Tuesday, THE RIGHT SCOOP is carrying it live, starting at 12 noon EST.

This gigantic embarrassment to our country will likely stretch into next week, with one break. Since one of Trump’s lawyers, David Shoen, is Jewish, he has requested that the “trial” be suspended by 5PM on Friday and re-convene on Sunday.

As laid out by the NEW YORK POST, the sham proceedings on the first day will go on for up to four hours, with the time divided equally between House impeachment managers and Trump’s attorneys. This is when they’re going to argue for and against the constitutionality of the proceedings before the trial begins, so be prepared for a lot of lies and false accusations about Trump.

Yesterday, we talked about what Jonathan Turley and other legal experts have had to say about this “trial” --- notably, its lack of constitutionality. Trump’s lawyers will be making those same points today. Since the Democrats don’t have the law on their side, and they know it, be prepared for a hate-filled, Jake Tapper-like focus on Trump the man. Realize that the House managers can say anything they want about Trump (and his supporters) on the Senate floor, and no one can do a thing about it.

The tone of their argument will be like this: Who needs to follow legal standards and precedent and offer even the most basic rights when it’s the evil Trump who stands accused? Why, this was a “coup” staged by him and a pack of domestic terrorists to overturn a “perfect” election and the will of the American people. We HAVE to circumvent the Constitution in this case to protect our democracy!

And Biden talks about “unity.” It occurs to me that there are actions we could have impeached President Obama for --- when he was still in office --- but we didn’t. I suppose that if it’s okay to impeach a President after he’s left office, Republicans in Congress could put together a list of charges against Obama, including things we learned about after he was out, and simply wait for a House majority. So far, we haven’t let Democrats drag us down to that level, and we shouldn't, but if they insist on treating Republican leaders this way, “revenge politics” could become the norm and the whole system would crash.

But Trump’s lawyers released a very positive statement, expressing appreciation that “Senate Republican leadership stood strong for due process and secured a structure that is consistent with past precedent. This process provides us with an opportunity to explain to Senators why it’s absurd and unconstitutional to hold an impeachment trial against a private citizen.”

Trump IS a private citizen. And with everything they’ve thrown at him, and even a bout with coronavirus, he seems as energetic as ever. When I think of them impeaching Trump NOW, when he's gone, and how ludicrous and surreal that is, I imagine him grooving to that song by the Eagles…

Woo-hoo-hoo...woo-hoo-hoo!”

Anyway, the Senate will end their first day with a simple-majority vote on constitutionality, which will probably come out the same as the 55-45 vote they’ve already taken. As Sen. Rand Paul has pointed out, this vote already tells Democrats that they don’t have the votes to convict, even with those ten "Republican" senators who voted to let this farce go forward.

Since this vote will really be just a formality, we assume that starting at noon on Wednesday, each side will present its case in up to 16 hours of “trial” spread out over two days. Neither side can go over eight hours total. After the opening statements, senators will have up to four hours to ask questions. If the House managers want to subpoena witnesses and documents, up to four hours will be allowed for arguments. Or, if they decide not to go that way, the “trial” will shift to four hours of closing arguments, additional time for deliberations as requested, and a vote.

Again, Democrats can say anything they want about Trump during opening and closing arguments. They don't need evidence to back it up. This might be their last big opportunity to trash him in such a formal setting, with TV cameras, so they'll pull out all the stops. Imagine the worst lies ever told by Adam Schiff, Eric Swalwell and Chuck Schumer, combined, and make that to the tenth power.

(It occurs to me that you really might not want to watch this. You know what we say here: "We watch the news...so you don't have to!")

Speaking of Sen. Shumer, he said of this process that “if the former President is convicted, we will proceed to a vote on whether he is qualified to enjoy any office of honor, trust or profit under the United States.” Schumer is talking about whether or not Trump is to be disqualified from running for President again, but constitutional scholars have said that the presidency is not an “office of honor, trust or profit.” Those are APPOINTED positions. The writers of the Constitution did not want senators to be able to override voters on their choice for elective office.

So --- hypothetically speaking, as the necessary 2/3 vote to convict seems unachievable --- if they did convict Trump and “disqualify” him from holding elected office again, the Supreme Court would have to decide if that was constitutional, and it almost certainly would not be. Most likely, in the end, the House and Senate will have wasted a week (and much more prep time) on this stagecraft, just to enjoy railing at an empty chair where their collective hallucination of Trump is sitting, and then they’ll vote, their vote will fall short, and it will be over.

Until somebody tries some other way to get Trump.

    Enjoying your Newsletter! Thought! If the Republicans all refused to vote on the impeachment it would show some solidarity in the party and the democrats would not have their majority. This whole impeachment is not constitutional and deserves no vote! Time for us Republicans to step up and show some guts!

    Hi, Mike, Thank you for an excellent article. My question is, if this whole impeachment conviction fails, can Congress go after Trump as a private citizen for "treason," or "domestic terrorism"? While they continue to completely ignore Antifa and BLM activities?

    Minutes ago I was watching the House meeting on clemency ... it's not really about that. it's about Trump. Imagine! I listened for about five minutes and see why I won't be watching the "trial." The chair first said Trump gave out the most clemency and awarded mostly to his cronies. I see exactly what will happen this afternoon ... fairytales about how the world was destroyed by Trump and how they can save us by ignoring the Constitution. Their fervor is frightening. BTW Obama was first then Harry S Truman, in clemencies.

    Governor, This is in reference to the self checkouts a some stores, I never use these lines. Here’s why, you are shopping, you take the item off the shelf and put it your cart, take it out of the cart to scan it, place it in a bag, this goes on till all has been scanned, put it back in the cart, go to your car, take it from the cart and place in your car. Drive home and Cary all your purchases in the house, wait though you aren’t finished, you have to put it all away. Ok how many times have you touched each item you purchased, that’s seven times by my count, if you force the store to scan, bag, put in your cart, and carry out to the car, that’s four touches you trim off the entire ordeal, I want the store to earn every penny of profit they make. That’s why I don’t use self checkout.

    We don’t need a third party— first of all there is the independent party so technically they should be saying forth party, but I regress— what we really need is bring back common sense and intelligence to all aspects of American life,including public schools and the teachers of all schools including colleges. Socialist ideas taught as if they are really good ideas while ignoring the truth about how many times they have failed to produce the desired results no matter who applied them is one huge issue in schools today that needs to be stopped. And maybe if children were taught to love the country they live in without being told it’s always been a horrible place for everyone but a few people, maybe they will do great things for everyone else. History is history— no one has a right to erase the truth of the past, except it for what it was, learn from it, love that the bad stuff lead to really good things for everyone and keep going in the right direction. Evolving is usually a good thing but today’s Democrats are regressing into a very mean spirited group of nasty mouthed people who only care about their agendas and damn anyone else even if they make sense in what they are trying to do. I used to go along with the Democrats but I don’t recognize them anymore. And they don’t look like any political party I remember in America at all. This circus in Washington DC has to come to its senses and certain members need to be voted out before they do horrible irreversible damage to everyone in America. Donald Trump had us all on a good path to get and keep America going in the right direction for everyone. What I’m seeing now is just the reverse. This is not what anyone needs.

    I have a different take, governor. Only a sitting president can be impeached and tried. Trump never conceded, and this is the democrats admitting that Trump actually won the election, and Briben is an illegitimate imposter.

    It seems that the Republican leadership is very slow to react to the ridiculous and unethical decisions made by the Democrats. The Dems stay about six months ahead of the Republicans much of the time. We keep hearing about term limits but never see any action. Term limits might be just the answer to our Washington elitist issues. How do we the people get this started and get back to following the Constitution?

    Dinesh D'Souza said that 'one armed disarmament doesn't work.' He further went on to describe during the Civil War how the Confederates were given to killing any black Union soldier prisoners. In order to combat this, Lincoln implemented a rule that for every black Union soldier prisoner killed, 2 Confederate prisoners would be killed. This in effect ended the problem.
    I'm not saying that we lie, cheat, and steal - we have to avoid sin at all costs. But let's be honest, there is enough dirt on the democrats to go after them in the same manner they attack conservatives.
    Until that happens, we will never see a change in behavior. The democratic party has no morals or values and is not grounded in faith in God.

    The viciousness of revenge and hatred is of satan. This makes me sick to my stomach. So sad that Godlessness is hurting so many. We must pray for Trump. He has good intentions and a heart that cares.
    The left is heartless, mean and nasty and God will judge them.
    I feel like this unfair unjust trial is a modern day copy of the unfair unjust trial of Jesus.

    Pelosi and others have said one of the reasons that this is being done is so that Trump cannot run again. What a corruption of government. We have congressthings working to take away options of We The People. They should be supporting who we want and respecting our choices and right to choose instead of limiting them. Who is working for who in this nation? This is swamp creatures at their most base level.
