It’s great to see so many readers engaging with us, commenting --- both pro and con --- on our voice of reason at this time of mass hysteria. We’re trying to get through all the letters, promise! Here are responses to two more...

I just have three quick questions:

1.) Since Senator Patrick Leahy is presiding over the 'impeachment' trial, does he have a vote on conviction? The Chief Justice does not have a vote, so why should Leahy, since he is assuming that capacity.

2.) What gives Senator Leahy the authority to preside anyway? I cannot anywhere in the Constitution that says this it is permissible for a Senator to preside over an impeachment trial.

3.) The impeachment articles were delivered AFTER Trump had left office, and was a private citizen, What gives the Senate the authority to try ANY private citizen?

The short answer: none of this is constitutional. They are making it up as they go along.

Having Sen. Leahy presiding over an impeachment trial is entering uncharted territory, since the Constitution says “the Chief Justice SHALL preside...” Chief Justice John Roberts has wisely chosen not to accept this dubious honor and will play no part in the "trial," so Sen. Leahy has graciously taken it upon himself. I assume he will decide for himself whether or not his vote counts. My guess is that it WILL. This whole circus is already so unconstitutional that, hey, why the heck not?

So, with President Trump already out of office and the Chief Justice not presiding, is what we have even a real impeachment trial? I’m not a legal scholar by any means, but I certainly have a lot of company in saying it is not. What we have here is a big fat banana-republic-style show trial. Your friend is correct in saying the Senate does not have authority to try a private citizen.

Accordingly, Trump’s attorneys are arguing that this entire process is unconstitutional, not only for the reasons mentioned above but also because the House impeachment was conducted without any due process. They also say that Trump is innocent of the charges he was impeached for, having never incited violence, and that they can present evidence that the Capitol breach was planned well in advance of his speech.

Democrats want to "convict" Trump because they think it will prevent him from holding office again, ever. They said he didn’t deserve to in their legal brief filed February 2. (The "trial" is scheduled for next week, starting February 8.) But legal experts point out that they don’t have this power other than with appointed offices, not elected ones. And to do this, even if it were constitutional, they’d have to reach a 2/3 vote on conviction, which they are not going to get.

Will this common-sense argument stop the Democrats? Of course not. But Sen. Lindsay Graham has said that if they call even one witness, Republicans will call a slew of their own, tying up the Senate for weeks at least. Maybe they'll even call the guy in the Viking helmet, if only to establish that he was there at the Capitol long before Trump gave his speech and didn’t even hear it.

Personally, I’d like to see the Republicans call John Sullivan, the left-wing activist who participated, was arrested and charged but then violated terms of bail. What was he really doing there?

I’d like to know how many other left-wing activists were involved in the Capitol breach. Again, we know the so-called insurrection was planned quite a while in advance and had nothing to do with what Trump said.

On the other hand, Trump’s attorneys say they won’t be bringing in the issue of election fraud. It apparently is not true that Trump parted ways with his previous team over that issue. New attorney Bruce Castor said, “There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it. President Trump has plenty to win with what he has.” Here’s more from THE EPOCH TIMES.

Jonathan Turley warned that even the House impeachment –- not even counting the Senate trial –- was doing great damage to the Constitution.

Turley said, “With seeking his removal for incitement, Democrats would gut not only the impeachment standard but also free speech, all in a mad rush to remove Trump just days before his term ends.” He said that Trump’s speech did not meet the legal standard for “incitement” and would be seen by the Supreme Court as protected speech. This sounds like just the kind of defense Trump’s attorneys are planning for his trial.

"The damage caused by the rioters...was enormous,” Turley said. “However, it will pale in comparison to the damage from a new precedent of a snap impeachment for speech protected under the First Amendment.” Of course, the House did it anyway.

Thanks for allowing me to comment, Governor. I am very disillusioned, with the Republican "club," and you. For two or three years, you have been chicken little on these CIA/FBI pending indictments. Time and again you breathlessly announced that charges, indictments and jail time was coming. The Democrats are destroying America with unbridled activism and relentless action while the "club" stonewalls and stands around in togas, all the while complicitly skewering Trump. Disgusting. 74 million Americans will not soon forget this insider treachery. Loyalty is supposed to work both ways. I wish Trump would start a 3rd party.

Thanks for writing, Paul, but I think you mischaracterize my reports. The investigations have been interminable, and I don’t think we’ve ever said anyone was going to jail. We’ve said people DESERVE to go to jail, which is a different thing entirely. I share your abject disappointment and disgust that no one has been held accountable.

We can tell you what investigators have turned up, and we can point you to solid sources and great books exposing much of the deep state, but as for accountability, well, we can’t do anything about that, much as we would like to.

So, you put me, personally, in “the club,” wearing a toga, standing complicit as the Democrats skewer Trump? Aside from thinking I might look pretty silly in a toga, I have to wonder where on earth you get that image of me. I ran for President; didn’t QUITE make it. I have no power to put anyone in jail, as appropriate as that might be. I've made it crystal clear what I think about the double standard of “justice” in Washington DC.

Right now, increased activism is the very thing I’m encouraging for embittered Republicans. As for starting a third party, that would be the worst mistake conservatives could possibly make. Democrats are hoping beyond hope that we do. Start a new third party, and conservatives will never, ever, ever win another Presidential election. Ever. Guaranteed.

    As you suggested I wrote to both Senators in my state. I've heard back from one of them and it wasn't favorable. I live in a predominantly Republican state. I was disappointed that one of the Senators of my state voted in favor of an impeachment trial for Donald Trump. I wrote to him giving reasons why this is a waste of time and money. I also reminded him that he was elected to that office as the spokesperson for the people in our state.
    His response did not address my concerns nor did he state that he heard from other constituents who are in favor of an impeachment trial. Instead he stated that "President Trump incited insurrection and therefore must be put on trial." He also said that it was his duty to be a "juror" in the Senate.
    I don't agree with his views but I'm more concerned that he isn't listening to his constituency. I wrote to him again emphasizing that he is in Washington DC to represent the people who put him in office. His response was the same as the first time with the added information that Biden won the election and Trump is just a sore loser.
    So, my question to you is, what do we do when our elected officials won't listen? Unfortunately this particular Senator's term isn't up until 2024.

    Concerning the impeachment trial. When the court convenes, it seems appropriate to me that the Trump legal team declare that the trial is unconstitutional and illegal and then walk out. They should not have to answer to a rogue House that has no accountability for their actions. If they acknowledge this trial then they are accepting whatever the outcome.
    Also, is dictator Biden going to spend his entire presidency in the White House writing executive orders?
    Is anyone taking bets on how long Biden will actually be in the White House before Pelosi and Schumer start trying to oust him to put Harris in that spot?
    You are doing a great job. Keep it up.

    Almost all of the current Republican party, minus only about six, have done nothing but let down and totally disappoint at least 75+ Americans who voted for President Trump and not for fraud China Joe. But since it appears that no one is going to do anything about a stolen election, and the corrupt Dem-Communist party will make sure they steal every election here forth, the Republicans will find out long before 2022, they have lost the respect and support (including financial) of at least 75+ million voters. The Republicans just roll over for Democrats, play along to get along and are traitors to Americans. Don't know about the third party, but Republicans screwed themselves with a huge number of conservatives and Patriots!!!! I will agree that Dems are hoping for an armed revolt so they can declare Marshall Law and seize the guns. But the Dem-Communist party will be going after our guns in so many other ways. They know they can't achieve their full Communist agenda and transforming America as long as Americans have guns. Time will tell but I believe many dark days ahead for America, even darker than the first two weeks of China Joe and his cheating political party!

    Your response to Gary: Thank your for your great answer. But.. it still doesn't explain why they are getting by with it if it does not follow constitutional laws. Why are there no checks and balances?

    Your response to Paul: 74 million of us (I think it's really 80) are so hurt and angry right now. It's sad. But I'm afraid far too many believed the QAnon cult garbage which always said Trump had "everything" and QAnons are the only ones who ever said a bunch of actions were imminent - none of it was ever true. Many even believed without the slightest idea that it originated with Q (many Christians in this group) because they heard from other sources. All those people are now more angry and more hurt than anyone. The "virtual reality" psychological game the Q creators played has badly harmed a whole lot of people - good people who were just desperately wanting and believing justice and truth would prevail. It's heartbreak multiplied because not only were they played and lied to there has not been any justice. And if elections are rigged as 80 million believe - there's no recourse either.

    But as for me and my house we will serve the Lord. He sustains us.

    Dear Gov. Huckabee, I'm a supporter of President Trump, and I will always believe that he won the election. I watched the coverage of all the poll watchers and their affidavits of the fraud they witnessed, as well as all those witnesses who testified about Dominion, and it's ability to be connected to the internet, etc. There is no way in Hell that Biden actually won, but it seems that he got away with stealing the election, and no one is doing anything about all the fraud. Why?!? I am also dismayed by the disloyalty of so many Republicans, whom I now consider traitors. I am even more disheartened because I sent a donation to Lindsay Graham so he could win his reelection bid, yet he didn't stand behind the President when he needed it most. As one of the millions who voted for President Trump, I want to see someone somehow get to the bottom of all the fraud. If someone really investigated, I'm sure they'd prove that President Trump actually won. I do believe a 3rd party would be a huge mistake, the Democrats would always win, and America will cease to exist. I do believe Washington is a swamp, most there have no backbone, and many are criminals. Does anyone have any interest in investigating the fraudulent election, or is America doomed?

    Brother Governor, I have a question, I don't understand why the Republicans will not stand up to these Democrats who are trying to seemingly destroy our country ? Why wouldn't they support President Trump ? As a Republican I feel that I was also stabbed in the back because of the fraudulent voting and certifications of electoral voting by Republican Senators. Is this going to be investigated ? Will we be able to trust the voting system ever again ? I know this is a lot but I think that 74.000.000 voters feel the same way ! Thank you ! Here is my question; the impeachment is something the Democratic Party is doing with their time (which they should be using to do what they were elected to do), and spending an enormous amount of our money that they are just wasting. What can be done with people like that?

    Isn't this what the ultimate goal is for democrats? They've been hinting around for decades that the Constitution is a 'living' or 'fluid' document subject to rewriting as the times change. Now, with their unholy control over everything political (except the Judicial branch, just a matter of time with them however), they are simply doing as they please. The Constitution is (appears to be anyway) irrelevant to the drastically liberal forces the likes of AOC and her Klan of miscreant Anti-Americans.

    Make no mistake, I am bitterly annoyed with the way this past election went. I truly cannot understand how many of those states could possibly reelect those uppity freshmen they put back under the saddle of the rest of the country in hopes of ruining everything that's made America the greatest melting pot country it is.

    I look forward to your newsletter everyday because you have a great way of making the current news readable for the non-legal mind. I hope that the so called ‘impeachment’ trial won’t be a grandstanding of socialist Democrats standing at the podium telling lie after lie. I believe Trump is innocent and this farce of a ‘trial’ is only a way to take eyes away from the voting irregularities that have happened, not only in 2020 but in elections before.
    As a Christian first and Patriot second, I am sad about what is happening in our country. I worry that the 74+million folks who supported Trump will get disillusioned and stop caring what happens in this country. That is the worst thing that can happen. But as I listen to podcasts, Rumble, etc and read conservative news sites, it is easy to get bogged down with The “this is the worst news today” mentality and become a hermit!
    I realize that I can’t change DC by myself, but I can work at the local level to help make sure my state legislatures know my opinion, work at the local level to help that in any way and keep my Christian beliefs and values represented. I need to remain positive and remember God is in control.... but he also provided me with a brain to work for him in all aspects of my life. It’s scary since I’ve never worked locally to support political issues, but as I’m in retirement now, I guess it’s not too late.

I get trump can be a tough act but the man has done right for America and that’s all Americans.     I've been following your assessments and found them very solid. However, regarding the sham impeachment trial going on, it seems obvious (to me at least) that the Democrats hope President Trump will sue and elevate his defense to the Supreme Court so the Democrats can argue a need to pack the court with leftist judges.

    Jonathan Turley outlines how the Dems will violate the US Constitution if they proceed with the impeachment. Also Mark Levin listed violations that Biden has committed with all of his executive orders, so what needs to be done for these people who are guilty? I heard Amy Coney Barrett during Senate hearings say more than once that there has to be a case presented in order for the Supreme Court to rule. So far I have not heard of any such cases.

    Governor, Thanks for allowing us to post. I want to speak on the proposed minimum wage hike.
    Our leaders in Washington have apparently had no economic training. Even without a college degree, some things are just common sense. My first real lesson in economics came when I was working at a lumber yard in high school. Minimum wage was $1.60 an hour (what I was paid). It was raised to $2.20 an hour and I was thrilled; I got a $.60 per hour raise without earning it! Then reality set in. I watched as studs increased in price from $.54 per stud to $.96 per stud. Sheetrock, plywood, other lumber, nails, etc. all went up in price. How else was the owner going to pay for wage increases and his cost for purchasing products to sell that had ALSO increased in price? I was a mere lad in high school, but I learned quickly what an increase in minimum wage really meant. If the increase being called for happens, it will immediately cause two things to happen. One, the costs of everything will at least double and two, people will LOSE jobs overnight. This was Economics 101 I learned in high school. Do our geniuses in Washington not get this or do they just not care?
