It’s great to see so many readers engaging with us, commenting --- both pro and con --- on our voice of reason at this time of mass hysteria. We’re trying to get through all the letters, promise! Here are responses to two more...

From Gary:

I just have three quick questions:

1.) Since Senator Patrick Leahy is presiding over the 'impeachment' trial, does he have a vote on conviction? The Chief Justice does not have a vote, so why should Leahy, since he is assuming that capacity.

2.) What gives Senator Leahy the authority to preside anyway? I cannot anywhere in the Constitution that says this it is permissible for a Senator to preside over an impeachment trial.

3.) The impeachment articles were delivered AFTER Trump had left office, and was a private citizen, What gives the Senate the authority to try ANY private citizen?

(asking for a friend)

From the Gov:

The short answer: none of this is constitutional. They are making it up as they go along.

Having Sen. Leahy presiding over an impeachment trial is entering uncharted territory, since the Constitution says “the Chief Justice SHALL preside...” Chief Justice John Roberts has wisely chosen not to accept this dubious honor and will play no part in the "trial," so Sen. Leahy has graciously taken it upon himself. I assume he will decide for himself whether or not his vote counts. My guess is that it WILL. This whole circus is already so unconstitutional that, hey, why the heck not?

So, with President Trump already out of office and the Chief Justice not presiding, is what we have even a real impeachment trial? I’m not a legal scholar by any means, but I certainly have a lot of company in saying it is not. What we have here is a big fat banana-republic-style show trial. Your friend is correct in saying the Senate does not have authority to try a private citizen.

Accordingly, Trump’s attorneys are arguing that this entire process is unconstitutional, not only for the reasons mentioned above but also because the House impeachment was conducted without any due process. They also say that Trump is innocent of the charges he was impeached for, having never incited violence, and that they can present evidence that the Capitol breach was planned well in advance of his speech.

Democrats want to "convict" Trump because they think it will prevent him from holding office again, ever. They said he didn’t deserve to in their legal brief filed February 2. (The "trial" is scheduled for next week, starting February 8.) But legal experts point out that they don’t have this power other than with appointed offices, not elected ones. And to do this, even if it were constitutional, they’d have to reach a 2/3 vote on conviction, which they are not going to get.

Will this common-sense argument stop the Democrats? Of course not. But Sen. Lindsay Graham has said that if they call even one witness, Republicans will call a slew of their own, tying up the Senate for weeks at least. Maybe they'll even call the guy in the Viking helmet, if only to establish that he was there at the Capitol long before Trump gave his speech and didn’t even hear it.

Personally, I’d like to see the Republicans call John Sullivan, the left-wing activist who participated, was arrested and charged but then violated terms of bail. What was he really doing there?

I’d like to know how many other left-wing activists were involved in the Capitol breach. Again, we know the so-called insurrection was planned quite a while in advance and had nothing to do with what Trump said.

On the other hand, Trump’s attorneys say they won’t be bringing in the issue of election fraud. It apparently is not true that Trump parted ways with his previous team over that issue. New attorney Bruce Castor said, “There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it. President Trump has plenty to win with what he has.” Here’s more from THE EPOCH TIMES.

Jonathan Turley warned that even the House impeachment –- not even counting the Senate trial –- was doing great damage to the Constitution.

Turley said, “With seeking his removal for incitement, Democrats would gut not only the impeachment standard but also free speech, all in a mad rush to remove Trump just days before his term ends.” He said that Trump’s speech did not meet the legal standard for “incitement” and would be seen by the Supreme Court as protected speech. This sounds like just the kind of defense Trump’s attorneys are planning for his trial.

"The damage caused by the rioters...was enormous,” Turley said. “However, it will pale in comparison to the damage from a new precedent of a snap impeachment for speech protected under the First Amendment.” Of course, the House did it anyway.

Thanks for writing, Gary; hope I answered your questions.

From Paul:

Thanks for allowing me to comment, Governor. I am very disillusioned, with the Republican "club," and you. For two or three years, you have been chicken little on these CIA/FBI pending indictments. Time and again you breathlessly announced that charges, indictments and jail time was coming. The Democrats are destroying America with unbridled activism and relentless action while the "club" stonewalls and stands around in togas, all the while complicitly skewering Trump. Disgusting. 74 million Americans will not soon forget this insider treachery. Loyalty is supposed to work both ways. I wish Trump would start a 3rd party.

From the Gov:

Thanks for writing, Paul, but I think you mischaracterize my reports. The investigations have been interminable, and I don’t think we’ve ever said anyone was going to jail. We’ve said people DESERVE to go to jail, which is a different thing entirely. I share your abject disappointment and disgust that no one has been held accountable.

We can tell you what investigators have turned up, and we can point you to solid sources and great books exposing much of the deep state, but as for accountability, well, we can’t do anything about that, much as we would like to.

So, you put me, personally, in “the club,” wearing a toga, standing complicit as the Democrats skewer Trump? Aside from thinking I might look pretty silly in a toga, I have to wonder where on earth you get that image of me. I ran for President; didn’t QUITE make it. I have no power to put anyone in jail, as appropriate as that might be. I've made it crystal clear what I think about the double standard of “justice” in Washington DC.

Right now, increased activism is the very thing I’m encouraging for embittered Republicans. As for starting a third party, that would be the worst mistake conservatives could possibly make. Democrats are hoping beyond hope that we do. Start a new third party, and conservatives will never, ever, ever win another Presidential election. Ever. Guaranteed.

Thanks for writing, Paul. I hope this clears a few things up.

Thank you Governor for this daily update, enjoy your words of common sense and wisdom.
All this hate from the left is nothing more than fear... they are so afraid of Donald Trump because they see how he can motivate and galvanize support across all socio-economic groups. They slander and attack any way they can.. it will not work! People will support a Warrior, a hard worker, man who is authentic and loves this country! PS Supporting your lovely daughter!

Blessings on you and your family as well, Governor.
Would you have any answer or speculation on why it is that Democrats have become so hateful towards what used to be "fellow" Americans and colleagues. It seems we have lost all moral compass when our government figures are able to accuse someone of "almost murdering", or that they encourage you to beat up people who disagree with you, or they tell rioters that its okay to destroy someone's business or home. Will there ever be just one Democrat with the courage to admit that this is all wrong?...I won't hold my breath.
Each day I am losing more hope that the freedom I came to America for has been decimated by those whom I trusted.

    Dear Mr. Huckabee,
My only problem with the Republican Party right now is the fact that very few of the leaders have a backbone! The party needs to be more unified! (Like the Democrats are ... gagging on my own words here) It is unfortunate that we Conservatives, who have placed our trust and beliefs in the Republican Party, are watching helplessly as our elected officials are playing defense instead of offense! It’s time to stand up to the craziness that is taking over our country. From the utterly ridiculous mask mandates to BLM and ANTIFA riots where NOBODY is held accountable! There are 75 million plus citizens in this country that are depending on our leaders to pull us through this dreadful place we currently find ourselves! If the Republicans that are in office will stand firm and remember all of us who are counting on them, with the help of God, maybe we can pull through this! Those Republican leaders who are siding with the Democrats in this farce of an impeachment trial will soon be packing their bags I can assure you. I do, with all my heart, believe that good always wins over evil!
But until “good” takes a stand, evil will continue to rule. Have a blessed day ??

Bro Mike, you say: "since the Constitution says “the Chief Justice SHALL preside...” Chief Justice John Roberts has wisely chosen not to accept this dubious honor and will play no part in the "trial," so Sen. Rush Limbaugh talked about this on his Monday show. I would be interested in your thoughts on it. I was shocked the George W. Bush played a role in helping the Democrats deceive President Trump into appointing Barr. That whole thing was far more evil than anyone could have imagined.

I am a huge follower and supporter of both you and Sarah. Your honesty is refreshing. I have a followup to a note from "Paul" that asks why no one on the Democrat side is ever indicted, let alone tried, for obvious illegal activity. Biden, Hillary, Barack, Comey, Brennan, et al. There is written and video evidence of lies, back room deals and quid pro quo. Why couldn't or didn't republicans move forward with anything outside of "Committee" hearings?? Call me

Dear Governor Huckabee, The overwhelming majority of elected democrats, largely representing the traditionally blue states of New York, New Jersey, California, Hawaii, and the New England states, as well as blue areas of red states, have clearly demonstrated they do not believe in:

    The Constitution as written
    One citizen: one vote
    Transparency
    Keeping campaign promises
    Keeping America first
The insane practice of borrowing money from China to support countries that hate the US, including China
    Military loyalty
    Police excellence

Given that the right, those areas not described above, does believe in these basic principles, why should we on the right not separate from the blue areas? A new country, comprised of the red states and areas, would be prosperous beyond belief: everything great about the United States, with little to none of the ills the left has inflicted on us all.

I apologize for the length, but I am at a point where I do not believe the left and the right can continue to coexist. Secession would be preferable to the inevitable end result of a civil war. Thank you. Chris Campbell, Tuscola, IL

Good answer for Paul. You might look quite handsome in a toga! :) We do not need a third party. President Trump should still be President and leader of the group. GOP faded away when the Bush bunch arrived and then let the Democrats start the downturn. This is not going to end well.

Sir, I agree that it is awful that people, agents of the FBI were killed in Sunshine, Florida but that does not take away that the FBI and CIA are being run against the American People and our liberties is wrong and the double standard Department Of Justice as Barr and now Durham but these entities will speak out about policeman that go to far in arresting a Criminal by putting a knee on his neck and making a vile person a martyr and the Comey's and Brenner's are just as much vile as the policeman that put his knee on the neck.
I know I do not trust the FBI or CIA anymore all this has brought back resentment of the Dividian compound and Ruby Ridge where black suburban's and helicopter lurking around the corner till the Deep State is named and brought out in the light by conservative news tellers can they be dealt with so will stay peranoid with itchy trigger fingers. With OBiden or no OBiden in office, he makes all worse.

    02/04/2021 01:36 PM

    Good morning Governor,

If I may respectfully comment on your response to Paul, and your assertion: "Start a new third party, and conservatives will never, ever, ever win another Presidential election. Ever. Guaranteed" and pose an honest question - Why in the name of heaven should conservatives continue to reward the Republican Party when they have consistently shown themselves to be unwilling to fight for anyone or anything?

If the GOP had spent half as much time over the past four years pushing back against the radical agendas and the racist, divisive, hateful, conspiracy-laden rhetoric propounded by "The Squad," the 1969 project, Antifa/BLM, Maxine Waters, and the likes of Adam Schiff and the "Stars of Russian Collusion" as they have spent in the past four days pushing against Marjorie Taylor Greene (called "cancer" by a certain Mitch McConnell, I believe) we might not be on the brink of living under an Orwellian hell ruled by unelected bureaucratic, unchallengeable medical-fascist "experts" appointed to govern virtually every aspect of our lives, technocratic overlords with more power and wealth than small nations and a Washington Plutocracy based on the whims of the Elite Ruling Class (GOP members included) rather than on the Constitution.

Why should we continue to support a corrupt insider's club that seems content to make all of the right "populist/conservative" noises during election time but which then turns around and endorses the same rampant deficit spending as the DNC? Why should we support a party that timidly and submissively bows down before every shred of opposition, frittering away our constitutional rights and economic solvency in the name of "appeasement and compromise" with an increasingly intolerant and uncompromising Progressivist Left. You think we should support a spineless GOP dominated by members that fear to be "called a bad name" by the Marxist media and the cry-bully demagogue ruling the streets of this country more than they fear to violate the promises made to their constituents? And worse, who leave their constituents helpless in the face of that same violent demagogue and the corrupt, leftist judiciaries that support it! Those same constituents who are now labeled "terrorists" and "radicals" and "members of hate groups" capriciously and arbitrarily by the very "cancel culture" that the GOP cowers in fear before, while the media calls for the formation of a proverbial Ministry of Truth! The same GOP that placidly allows Marxist, racist BLM ideologies to be propounded in our schools as though a subjective political theory were absolute dogmatic fact, while simultaneously doing virtually nothing to defend the rights of parents and students who say "no, enough!"

Has the GOP stood up for equal application of the rule of law for the "liberal" and the "conservative" alike? I think not. God forbid they actually stand for equal justice where the corrupt, agenda-driven FBI and the DOJ are concerned! Have the stood against Big Tech censorship? Have they stood up against rampant, slanderous media bias? Have they stood in defense of religious liberties or the rights of small businesses or free speech? Have they stood up against the radical abuses committed by "Cult of Covid" and its ever-moving goalposts as our rights to so much as exit our homes and breathe the free air are stripped away? Certainly a small, notable handful of conservatives within the party have done so, in drips and drabs - but on the whole what has the GOP done but serve its own interests and profit from our misplaced trust? And you wonder why America elected a loud-mouthed businessman from New York and catapulted him nearly to cult-status? Perhaps it's because Trump actually fought for something, stood for something, and didn't bow down before a cabal of bullies and "compromise away" the founding principles of this nation! Who is left in the GOP that has the spine to say the same and back that statement with action?

If this country is to become a dystopic Orwellian hell run by an Elite coterie of unopposed and unopposable Globalists Marxist Progressives - if it is to be enslaved by Big Tech and owned by the CCP - then sooner would I waste my vote and ensure that the spineless oath-breakers known as "Republicans," at the very least, get to suffer the same poverty, "cancellation" and ignominy that has been forced on the American populace by the Left.

Assuming that our votes even count anymore - we will never truly know, will we? Because the milquetoast, simpering "establishment GOP" won't pursue any real, public, transparent inquiry into whether 75-80 million Americans were deceived by Trump's "irresponsible rhetoric" or whether there actually was foreign influence and voter fraud on a level significant enough to alter the outcome of the 2020 election! Questioning that narrative with little things like video evidence, sworn affidavits, the unprecedented determination to stop counting the votes in the small hours of the morning, the videotaped instances of chicanery preventing conservative poll watchers from entering certain facilities, and the mathematical improbabilities of more people votes being cast in a location than there are residents is Verboten after all!

It certainly won't matter next election, either, when "mail in ballots" and the slew of other Leftist ideals of "voter reform" become the standard. Under that system "conservatives will never, ever, ever win another Presidential election. Ever." anyway. So why bother? Let the GOP die with the liberties that it failed to preserve for the past 30 years, and suffer right along with the rest of we the unimportant "systemically racist, insurrectionist, unenlightened, white-supremacist, bigoted, terrorist, deplorable serfs" formerly known American citizens.

Never, never, and never again while this spineless, divorced-from-reality, political-insider's club mentality prevails will I ever cast my ballot for the "lesser of two evils" GOP.

If a person or group continues an action when the outcome is already known, it seems that a sane person would say why? Perhaps Trump derangement syndrome -trying to make sure we never hear from him again. BUT -personally, is it possible that Nancy Pelosi, who has years of experience maintaining power, delayed delivery of 2nd impeachment to give cardboard cutout man Biden + people behind him time to enact all those executive actions and grab even more power while the media distracts with impeachment stories?

  • Linda Meadows

    02/04/2021 01:28 PM

The Democrats have as much evidence as they did for President Trump’s first impeachment. In the first one, the phone calls, with Ukraine, proved he was innocent. This time around, proven timing of the events and his speech proves he is innocent. It doesn’t matter how much evidence is presented, Nancy Pelosi and her bunch are tone deaf and refuse to accept proof. I don’t understand how voters can continue to put these people in office. They always make promises they don’t keep. I have a friend who told me she had to vote Democrat because they were for Unions. Biden’s executive orders have blown that theory out of the water.

I enjoy your articles and am glad someone seems to have a handle on the Democrats actions as well as the RINOS. Keep up the good work.

Since the whole so called impeachment is not valid according to the constitution I think a really good lawyer should file in federal court saying the democrats pushing this process stand in violation of their oath to follow the constitution and need to be removed from office for that. If they are allowed to get away with this they will just continue to impeach any republican president who takes office with one bogus charge after another. Put a few of those leading the charge in prison and see if they start acting right.

I am extremely concerned by the leadership in the Republican party these days. DAILY I receive email requests asking me to donate to the party and help them fight the injustices of the demoncratic party. (Not a typo) My frustration with the Liz Cheney’s, Lindsey Graham’s and even Mitch McConnell is because they are truly out of touch with what is important to true voting Republicans. I don’t condone what happened on January 6th, believe me, grown people should know better. BUT I also understand their frustration at the corruption playing out right before our eyes. The majority of the working class is watching our rights be violated and stripped away while Mitch watches from the sidelines. The decorum that McConnell claims to adhere to makes me believe he is more concerned with the “show” or “performance” rather than doing what is right for those who elected him and his colleagues. I saw an earlier comment about forming a third party and can see why it’s a popular idea. REPUBLICANS need to understand that if they don’t start paying attention to their constituents, THEY will be to blame for the failure of the party. I will not contribute a penny to a self serving corrupt party, I am not alone. Maybe before sending out another request for donations they should come clean and ask for forgiveness and maybe just listen to those who elect them. When the history books are written, it will be the Paul Ryans, Mitt Romneys and the others listed above who dismantled the Republican party. Makes you wonder if that was the plan all along. We need term limits and more accountability. Less fundraising and lobbying and more responsible lawmaking. Our country has become a laughingstock- but it was happening well before Donald Trump. Although you may not agree with his tactics or personality- he listened and got things done. He gave hope to those that truly love our country.

Last year was so stressful, what with the constant berating of President Trump, the virus, wearing the Chinese face mask, businesses and churches closing, not being with family and then the farce of the election. Nothing makes sense anymore.
If Walmart and Costco can be open, everything should be open! Now Fauci wants us to wear two masks? It’s so depressing. Governor, your emails are the only thing keeping me sane!

I read in your newsletter today about the unconstitutionality of the democrats current impeachment effort. I agree..You also said they open up a can of worms to retroactively impeach Hillary Clinton but she was never a president or did I miss something? What would be even more effective would be to retroactively impeach Barrack Obama for giving the go ahead to spy not only on Trump's campaign but also on his administration. Let me know your thoughts.

I don't believe we should worry too much about the Democrats wish to make Washington D.C. a state. Article I, Section 8, Clause 17 sets it up as a district governed by the Congress as the "seat of government". Therefore it would take a Constitutional Amendment to make it a state. The 23rd amendment only provides for the ability for the residents of Washington D.C. to have electors for the presidential and vice presidential elections. Amendments to the Constitution of the United States require a 2/3 vote both the House of Representatives and Senate and then ratified by the "Legislatures of 3/4 of the several States".

The abolishment of the Electoral College would also take an amendment to the US Constitution also as it is specifically set up in Article II, Section 1, Clause 2 and the 12th Amendment.

The US Constitution is a very easy document to read and understand except, it seems, for lawyers and politicians serving in the Federal Government.

Thank you for taking the time to read the thoughts of a fellow transplant to Florida.

Election 2024 Coverage

February 4, 2021

Leahy has graciously taken it upon himself." How is it that Justice Roberts can "choose" to not perform his constitutionally required duty? And how is it that Leahy can "take it upon himself"?

  • Terry Larson

    02/04/2021 01:15 PM

    February 4, 2021
    |

      Dear Mr. Huckabee,
My only problem with the Republican Party right now is the fact that very few of the leaders have a backbone!

I love your comments, well opined and researched. I also adore your daughter -- but please tell her that the past several years of donating to every Republican Tom-Dick-and Harry has been onerous.
At some point I will send $$ her way, but not monthly or weekly or under duress. Give her my best wishes, but take some for yourself, to

Bro Mike, you say: "since the Constitution says “the Chief Justice SHALL preside...” Chief Justice John Roberts has wisely chosen not to accept this dubious honor and will play no part in the "trial," so Sen. Leahy has graciously taken it upon himself." How is it that Justice Roberts can "choose" to not perform his constitutionally required duty? And how is it that Leahy can "take it upon himself"? Hi Governor Huckabee,
Rush Limbaugh talked about this on his Monday show.

Call me

I would love for once in my lifetime like to see the Republicans take a stand against the Democrats. And give exactly what they’ve been given. I think on day one of the impeachment trial they should ALL stand up and turn their backs to the Democrats and refuse to even acknowledge this farce.

      Have a blessed day.
