The Capitol Hill security breach on January 6 was reported as an “insurrection,” a “threat to our democracy” and an attempt “to overturn the 2020 election.” House Speaker Nancy Pelosi, after failing to provide adequate security for President Trump’s rally --- he had approved thousands of National Guard troops for the event, which she did not use --- overreacted spectacularly, bringing in the Guard after the fact and ordering the installation of tall fencing topped with razor wire all around the Capitol area. President Trump was accused of inciting the “rebellion” and even impeached for this (even though we know it was impossible for those who entered the Capitol that day even to have heard Trump’s speech). The message to Trump supporters was loud and clear: we see you as a threat.

Don’t misunderstand: I have said from the first that it was stupid and wrong to get out of line and enter the Capitol that day, let alone to cause vandalism and attack Capitol Police. A woman was killed. And those who participated in any way gave Biden’s political team a priceless GIFT --- an excuse to wrongly tag all Trump supporters as part of a rowdy mob that needed to be held in check.

But, really, what kind of an “insurrection” is it when not one firearm is confiscated? Were they seriously trying to overthrow the United States government? With what? A few baseball bats and flagpoles? The idea is ludicrous.

And now, with hundreds of cases clogging the courts in Washington DC, we’re seeing that most of these deal with little more than trespassing. To be sure, some will be charged with more serious crimes, but many of the Trump supporters who walked into the Capitol Building that day had no intention of breaking the law and didn’t even think they WERE. At some entrances, security was so lax that police were just letting them walk right in. Elsewhere in this newsletter, we have the story of one such case, a man and his mother who had simply walked into the Capitol. They were arrested in January and have been in jail all this time (!), but a federal appeals court has said their case “needs a new look.” Thank goodness; these people pose no threat.

In light of this, POLITICO ran a piece on Tuesday that it probably pained them to include, headlined “Many Capitol Hill Rioters Unlikely To Serve Jail Time.”

Subhead: “The cases could embarrass the Biden administration, which has portrayed the Jan. 6 siege as a dire threat to democracy.”

Of course, they make up for having to tell this story by using a photo that confirms their view of Trump supporters, as it shows a few of the rowdiest. And –- oh, no! –- they’re holding American flags, which is bound to “trigger” many of their readers.

Authors Josh Gerstein and Kyle Cheney break the sad news that DC prosecutors in federal district court are needing to dispense with the large number of low-level cases related to the Capitol breach, and that “in recent days, judges, prosecutors and defense attorneys have all indicated that they expect few of these ‘MAGA tourists’ to face harsh sentences.” One reason for this: “Although prosecutors have loaded up their charging documents with language about the existential threat of the insurrection to the Republic, the actions of many of the individual rioters often boil down to trespassing.”

The authors quote Erica Hashimoto, a former public defender who is now a law professor at Georgetown University, who said, “One of the core values of this country is that we can protest if we disagree with our government. Of course, some protests involve criminal acts, but as long as the people who are trying to express their view do not engage in violence, misdemeanors may be more appropriate than felonies.”

The Biden administration exaggerated the January 6 “insurrection” to such an extent –- Biden himself has said it “borders on sedition” –- that it’s going to be challenging for them to deal with the many light sentences likely to be handed down. Attorney General Merrick Garland has called the event “a heinous attack that sought to disrupt a cornerstone of our democracy, the peaceful transfer of power to a newly elected government.” (Really, all they really wanted was a transparent vote count.) And, as the POLITICO article reports, “Justice Department prosecutors sent expectations sky-high in early statements and court filings, describing elaborate plots to murder lawmakers --- descriptions prosecutors have tempered as new details emerged.”

So, what are they going to say when scores of people receive their verdict of “GUILTY”...for trespassing? Unlawful presence? Disrupting official business? And nothing more sinister than that?

You can tell they’re in trouble politically when the narrative starts changing, especially when it goes to the subject of race, and that’s already happening. For example, in the POLITICO story it says, “The resolution of the more mundane cases...presents acute questions about equity, since most of the defendants are white, while misdemeanor charges are often a vexing problem for minority defendants in other cases.” The discussion will become about that; you watch.

Of course, they’ll also capitalize on the relatively small number of serious charges that stem from this, but those could take many months or even a year to come to trial.

It should be noted that in telling this story, POLITICO is itself guilty of exaggerating what happened that day, by saying without elaboration that it left five people dead. The writers surely know that there was only one death conclusively associated with the “invasion” of the Capitol Building, and that was the unarmed woman shot by a Capitol Hill officer. They also cast blame on Trump, writing that many rioters “have said they took Trump’s own words as the inspiration...” Maybe they felt that way, but we know they didn’t even hear his rally speech and that Trump had not called for anything like what they did.

The Justice Department has been exaggerating, too. In fact, by video conference last week, District Court Judge Amit Mehta lit into the DOJ for granting media interviews and throwing around terms like “seditious conspiracy” --- a very grave charge --- when they haven’t actually charged anyone with this. What this judge has to say about defendants’ rights is music to the ears. The judge is considering a gag order, which is a great idea because trying cases in the media should make us all, well, gag.

    Thank you for your honesty in All matters; The Demon-crats will get their dues .     The narrative that Trump Supporters wanted to stop congress was wrong. The real Trump supporters wanted to support the congress in debating the votes and to make sure all evidence was seen on television news programs. The riots stopped the evidence from being seen, and the left won the debate, without evidence.

    I read you daily emails with anticipation. Always love your humor mixed with truth!
    This is off the subject though. Governor I know you contribute to the charity to help and feed the Jewish Holocaust victims. And I want to do it too! As soon as I receive my stimulus check! What bothers me is why doesn’t the Prime Minister take care of these people? My heart breaks for them. Is there no way for the government to help them?

    I watched live coverage by the Victory Channel that day, all day. They have footage of cops moving barriers, waving people toward the steps of the Capitol, and people filing in past a row of police. If I had been there, I would have gone in out of curiosity alone. Months in jail is a high price to pay for accepting an invitation from law enforcement personnel.

    I get the impression that a great number of the January 6th capitol rioters are still in Jail. Is there no bail set for these people, many of whom are guilty of nothing more than trespassing?

    Mike, I enjoy reading your articles daily and appreciate “hearing the truth.” I find it appalling the liberal media and democrats can just misrepresent or totally lie about issues. And then just move on as if nothing happened. The “claimed January insurrection” will be the next story put to the wayside due to lack of proof. I believe the democrats would do anything dishonestly to mar the minds of people to gain politically regardless of cost. Their intent is to just leave a reasonable doubt in the voters minds for any political election at any level. What sick minds!

    It is a topsy turvy world out there right now. Of course I am old and see things different than these young kids. But it seems to me, some of the wisest words spoken will apply to this period of time. We are being told and taught, what is right is wrong and what is wrong is right. I see it all around me. Thank you for your news letter. It is the best out there. And I sure wish I could vote for Sarah in her run for Governor.

    Those who did nothing wrong, and know it, should ask for a trail by a Jury of their Peers. Clog the court system - have the cases thrown out - make the D o J / FBI appear Bozo-istic. (Key-stone?)
    When all is said and done - I feel maybe thirty will get some type of Jail - and on appeal - released, time served.
    This needs to be memorialized in a song, 'Remember when?'

    Governor, love your newsletters and the careful way you assemble the stories and links to provide a fair presentation. However, in the article on the Equality bill that would erase women's rights, it accuses SD Gov. Kristi Noem of "caving to pressure" by not signing a bill preventing biological men from competing in women's sports. I've heard her defense and that badly mischaracterizes her position. She is actually trying to strengthen the bill and build a multi-state coalition to make sure it will stand up in court. Please review and correct the misconception. She's someone I'm glad is on our side.

    In my view, the capitol policeman that shot the only person killed on Jan 6 should be charged with manslaughter. From what I could see, it was obvious she was unarmed and why aim at her? There were plenty of men to shoot at but not so many women, why pick on her? Why are no charges being brought against him? Thanks for your help clarifying this for me, Mike, I appreciate your honesty (and your sense of humor!).

    I want to ask you, why all the talk about Biden, Harris and all the democrats that are destroying America? when NOTHING is being done about it. Does the senators and representatives not have any power in DC or are they just paid useless employees of taxpayers? Even Elvis said..a little less talk and a little more action.     Hi Mike. I received your email asking for support for Sarah’s campaign for Governor. I responded to that email but not knowing whether that’s one of those no response email items I wanted to share my comments here since I am a big fan.

    “Mike, I have contributed to Sarah’s campaign a few times, not because she’s your daughter but because she’s tough, smart, a patriot, hard working, family oriented, pro life and has a strong Christian faith. I don’t even live in Arkansas. Wish I did since Virginia is run by leftist lunatics. Sarah will make a great Governor.”

    I am a big fan of you both. It isn’t hard to realize those fine qualities possessed by Sarah came from exceptional parenting, by her mother. Ok, just kidding, from you and Mrs. Huck.

    I am often too busy to sit and read your thoughtful words but I started to today at the start of a much needed trip for me....1st time flying since 2019! I plan to relax and catch up on all your wisdom and can hear your voice (it’s much like my father’s though you and I are the same age!) It is so comforting to read your views even when the news is bad but you try to explain things so well and you have a great wit! My father is almost 90 and a hardcore businessman like Trump and a lifelong conservative so he has seen a lot and knows a lot. Thanks for your uplifting words and prayers!

    I would love to see the emails between Nancy Pelosi, other Dems, and Security. I am thinking she is involved in setting up President Trump and his supporters by allowing or inviting Antifa members to come and do their thing. I watched the Rally all the way through on TV that day and never saw or heard President Trump or any other speaker say or do anything to suggest rioting or violence.

    Now Nancy Pelosi is trying to overthrow the Iowa Election to gain another seat. This action is the same action that the Trump Supporters were asking to do for the November Election. If she is able to do this, perhaps it is time for the Republicans to get another chance at overthrowing the November Election. Especially if she or any Democrat were involved in setting up the riot to hurt the Republicans and President Trump

    If anyone can say they are an American and can mail in ballots for themselves and others from anywhere - as many as they want, what is there to stop illegal votes for the Republican party on the same scale as the fraud committed by Democrats? If the votes from "Americans" in foreign countries are legitimate unless proven to be fraud what can anyone do about it? Will "Democratic" states only check "republican" votes and vice-versa? I don't see how this law can work for anyone.

    Thanks for your newsletters. Just know that if our toilet paper was made here in the USA it did not need to go on a cruise through the Suez Canal. I would prefer to go on that Cruise instead of the TP. No wonder TP is costing more all the time. Cloth works and you can wash and reuse!

    Insurrection, sedition but no weapons?
    The real culprit of this planned invasion is Nancy Pelosi, who should be impeached for her actions, and for not providing additional security.

    Has it occurred to anyone, and has anyone investigated Nancy Pelosi’s actions leading up to the invasion? Nancy had plenty of time to hire or have hired professional rioters to disrupt the Trump rally. I believe that is why she did not hire any extra security for the Capital. She wanted a large group of people pushing their way into the Capital. That didn’t exactly happen but Nancy always figures out how to get her way.

    She managed to impeach Trump and label all his followers racists.

    I think it is now time for Nancy to be impeached. Shouldn’t be to hard to find multiple reasons.
