I’m glad to see that red states are taking a page from the liberal playbook and using federal lawsuits to block President Biden’s executive orders, the way they hamstrung Trump for four years. In this case, it’s 12 states (and why only 12?) suing to stop his executive order that will greatly expand federal climate regulations, cost billions if not trillions of dollars, and destroy thousands of jobs across multiple industries.
The suit argues that the order is illegal because Biden has no statutory or constitutional authority to “dictate specific values for the ‘social costs’ of greenhouse gases in virtually every regulatory program administered by the federal government.” That sort of expansive policy is “quintessentially legislative” and belongs only to Congress. Meanwhile, Arizona and Montana have filed a lawsuit to block Biden’s order that severely limits the number of illegal immigrants who can be arrested and deported. Arizona Attorney General Mark Brnovich said, "If asked about the poorest policy choice I’ve ever seen in government, this would be a strong contender. Blindly releasing thousands of people, including convicted criminals and those who may be spreading COVID-19, into our state is both unconscionable and a violation of federal law. This must be stopped now to avoid a dangerous humanitarian crisis for the immigrants and the people of Arizona."
These are the kinds of lawsuits that make me thank God Trump was able to appoint so many judges, which may be his most lasting legacy to protect America.
